WORKERS’ COMPENSATION AND DISABILITY BENEFITS
Work injuries can come in many forms, from minor sprains to life-altering disabilities; however, most states, including Kentucky, recognize four kinds of disability benefits that one may be eligible for through workers’ compensation.
- Temporary Total Disability
- Temporary Partial Disability
- Permanent Partial Disability
- Permanent Total Disability
While your ability to retain these benefits usually lasts until your doctor has determined that you have received Maximum Medical Improvement, cases involving long-term disability may vary. Read on to learn more.

PERMANENT DISABILITY BENEFITS VS. LONG TERM DISABILITY BENEFITS
The length of time in which you can receive workers’ compensation benefits for a permanent disability is largely dependent on the severity of your injury. If you qualify for Permanent Total Disability benefits, you may be able to maintain these benefits until you turn 70. However, for Permanent Partial Disability, your benefits can last between 425 and 520 weeks, depending on whether your disability rating is above or below 50%.
In some circumstances, you may be able to retain both workers’ compensation disability benefits and long-term disability insurance (LTDI) benefits simultaneously. On the other hand, you may find it more beneficial to wait on applying for LTDI until your workers’ compensation benefits are coming to an end. Either way, working with an experienced workers’ compensation and disability attorney can help ensure you thoroughly understand the process and receive the compensation you deserve.
