Workplace Exposure

Louisville Workplace Exposure Lawyers

A Proven Record of Winning Results

If you suffered serious injuries or a debilitating illness after being exposed to harmful chemicals or other dangerous substances at work, you likely have grounds for a workers’ compensation claim. In Kentucky, nearly every employee is covered by their employers’ workers’ compensation insurance; only certain agricultural workers, independent contractors, and most volunteers are ineligible for workers’ comp. Additionally, under state laws, workers’ compensation covers injuries, illnesses, and conditions caused by on-the-job exposure to harmful or toxic substances. If you are a victim of workplace exposure, or if your loved one died due to a work-related illness caused by occupational exposure to a harmful substance, contact the Justice Injury Law. Our experienced Louisville workplace exposure lawyers can help you seek the full benefits you are owed.

When Is Workplace Exposure Covered by Workers’ Compensation?

Like any other work-related injury or illness, harmful exposure is covered by workers’ compensation when an individual is classified as an employee and sustained the injury or developed the illness at work or while carrying out any duties that benefitted his or her employer. So, for example, if you worked in the construction industry and were later diagnosed with mesothelioma after being exposed to building materials that contained asbestos, you could seek compensation for your cancer treatment costs, lost wages, and other losses.

If you have questions about your situation or if you need help with your workers’ compensation claim, contact the Louisville workplace exposure attorneys at our firm to learn how we can help. What Is Workplace Exposure?

Workplace exposure occurs when an employee is exposed to any toxic, dangerous, or harmful substance in the course of his or her work. Kentucky occupational safety laws prohibit exposure to certain levels of specific substances that are known to be harmful. These substances include both those that pose health hazards, such as substances that are carcinogenic or that cause irritation, and physical hazards, including substances that are highly flammable or corrosive.

Some examples of harmful substances that employees across a variety of industries are commonly exposed to at work or in the course of their employment include:

  • Asbestos
  • Bacteria and viruses
  • Mold
  • Sewage
  • Bodily fluids
  • Radioactive substances
  • Corrosive chemicals
  • Explosive/flammable liquids
  • Carcinogens
  • Diesel engine exhaust
  • Arsenic
  • Solar radiation
  • Pesticides
  • Dangerous compounds

Workplace exposure can also refer to harmful noise levels, which can lead to catastrophic hearing loss when employees are not properly protected.
